MOONCAKE Visuals - UEVS Terms of Service Agreement This Terms of Service (the "Agreement") is entered into by and between MOONCAKE Visuals, hereinafter referred to as "the Company," and the user of UEVS, hereinafter referred to as "the User." This Agreement governs the use of UEVS and associated services provided by MOONCAKE Visuals.
Acceptance of Terms By acquiring, downloading, or using UEVS, the User acknowledges and agrees to be bound by the terms and conditions outlined in this Agreement.
Software Access and Upgrades
2.1. Access to Future Release Content
Users obtaining UEVS are granted perpetual access to future release content. However, upgrades introducing new features will require a separate upgrade, which is often more cost-effective than the regular purchase.
2.2. Transferable License Keys
License keys for UEVS are singularly valid for one node and can be deactivated and reactivated as needed. Additionally, license keys are transferrable, allowing users to transfer their license to another user.
2.3. Addon and Template Licenses
When a user acquires a license for a specific addon or template, the license is tied to the one acquired and cannot be transferred or switched to another addon or template.
2.4. Monthly Rent Option
In addition to traditional licensing options, a monthly rent option is available for users who prefer a subscription-based model. This allows flexibility for users with short-term project needs.
User Support
3.1. Priority Support Maximum response time of 24 hours.
3.2. Community Channels General Discord channel and WhatsApp channel are available for the community.
Software Usage
4.1. Unlimited Commercial Usage
Users are granted unlimited commercial usage rights for UEVS across all versions.
4.2. Restrictions on Redistribution
Redistribution or resale of UEVS is strictly prohibited. A designated affiliated market is provided for transactions involving redistribution and resale.
License Keys
5.1. Activation and Deactivation
License keys for UEVS are singularly valid for one node and can be deactivated and reactivated as needed. However, only one node can be active at any given time. License keys are transferrable, allowing users to transfer their license to another user.
I/O Workflows
6.1. User Responsibility
UEVS supports multiple I/O workflows. Users bear the responsibility for their own structuring and external workflows, with no provided support for these elements.
Content Responsibility
7.1. User-Created Content
MOONCAKE Visuals assumes no responsibility for any content created by the user through the use of UEVS.
7.2. Copyrighted Material
MOONCAKE Visuals is not responsible for any copyrighted material used by the user within UEVS.
User Data Collection
8.1. Basic Contact Data: UEVS only collects basic contact data provided by the user at the moment of obtaining the software.
Custom Virtual Studio Service
9.1. User's Responsibility
MOONCAKE Visuals disclaims any responsibility for any studio provided by the user as part of the custom virtual studio service. Users must possess 100% rights to the content they wish to include.
Refunds
10.1. No Refunds
Please note, we do not offer refunds. Explore our software through trial versions on our website or contact us for trial options.
Updates and Notifications
11.1. Notification Method
Users will be notified by Email and within the app. Opt-out can be done via Email, but in-app notifications will be constant as the app is continually improving without causing visual annoyance.
Termination
12.1. Termination Conditions: The Company reserves the right to terminate a user's access to UEVS if there is evidence of software piracy or any license hacking attempts.
Liability Limitations
13.1. Limitation of Liability
MOONCAKE Visuals is not liable for any direct, indirect, or consequential damages arising from the use of UEVS.
Modification of Terms
14.1. User Agreement to Changes
Users are required to accept any changes to the terms of this agreement. Notification of changes will be provided through appropriate channels.
By acquiring, downloading, or using UEVS, the User acknowledges and expressly agrees to comply with these terms. MOONCAKE Visuals reserves the right to modify these terms as necessary, and it is incumbent upon the User to periodically review them.
This Agreement is effective as of 01/10/2024.
